Activist Monday: MoveOn.Org Freaks Out Bobby Jindal

Happy St. Patrick’s Day, all!

Ah, Republicans and their selective “reading” of the Constitution. Those who seem to understand that the Constitution does, in fact, contain a First Amendment guaranteeing Freedom of Speech, also appear to feel it applies to Republicans and Republicans only.

In Louisiana, MoveOn.org paid for a blackboard to advertise that Governor Bobby Jindal, our Fredster’s most Favorite Governor Evah, is denying hundreds of thousands of Louisianans the benefits of Medicaid. Here it is:

Now, maybe I’m way off here, but this seems like a rather factual poster. No one is calling Governor Jindal names or disrespecting him in any way. But as we know, the Right’s passionate belief in freedom of speech for racists like Ted Nugent (who famously called President Obama a “sub-human mongrel”), does not extend to those who expose their heartless and hateful policies towards the poor, the sick and the otherwise unfortunate. So, the Governor and his cronies have decided to sue MoveOn.org, allegedly because they used the state’s slogan {“Pick Your Passion”) in the sign.

Having already served Move.org with a cease-and-desist letter requesting that the organization remove a billboard critical of Gov. Bobby Jindal (R), the state of Louisiana filed a lawsuit against the group on Friday claiming trademark infringement.

According to Times Picayune, the lawsuit, filed in federal court, claims MoveOn.org violated trademark law by putting up the billboard and running television ads critical of Gov. Bobby Jindal that use the state’s tourism logo and motto.

Pointing out that  “it is very sad to see the state spend taxpayer money on a frivolous lawsuit instead of providing health care to the people of Louisiana,” MoveOn.org Civic Action’s Executive Direct Anna Galland added. “Once our lawyers receive and have a chance to fully review the complaint we will have more to say. In the meantime, we strongly urge Governor Jindal to do the right thing and allow 242,000 Louisianans to access Medicaid.”

Keith Werhan, constitutional law professor at Tulane University Law School, said suits of this type are rarely successful.

“The government can’t legally silence those who are criticizing them.”

It looks like Professor Werhan has a strong grasp of the meaning of the First Amendment. And, MoveOn.Org’s activism must be working, or the state wouldn’t be working so hard to suppress their efforts. So, good for you, MoveOn.Org! For today’s activism, maybe you can thank the folks in the organization for being a thorn in Bobby’s side. Or, you can do as the ad below suggests, and call the Guv himself about his disgraceful denial of health care to so many of his constituents.

poor old bobby Jindal… Meanwhile in the sunshine state someone has set up a face book page that has a catchy name and doesn’t appear to be what it reports to be.

Someone or a group of someone’s Has created a page titled “Re-elect Rick Scott Governor of Florida 2014” The Group calling itself “The Real Republicans” has this to say:

“We the real Republicans of Florida do not want to be confused with those revisionist Republicans and Tea Party Republicans. We are hard Core and Believe in 100% Personal Responsibility. We like our governor want to reduce the minimum wage back to $3.65 per hour like it was when Reagan was President. We want to make healthcare unavailable to our residents. We want to end Social Security, Medicare, & Medicaid. We want to make Union Organizing Illegal punishable by death.”

While it sounds just awful errr truthful…. every post by these folks it very critical of Rick Scott. Not one positive article on the entire page.

Wonder who could be doing this?

Great post, MB. Denying people Medicaid benefits because they have the misfortune to live in a state governed by an a-hole makes my blood boil.

Gov. Pence is denying Medicaid benefits to thousands of Indiana residents, too. I wish the MoveOn organization would protest that. As far as I know, they haven’t put up any signs here.

A friend of mine broke her neck after falling on the ice a few weeks ago. She is now paralyzed from the neck down. She is ( was ) a working single mother but she had no health insurance. Under Indiana’s rules ( which I don’t understand ) she does not qualify for Medicaid. She is still in the hospital, worrying about medical bills while not knowing if she will ever walk or use her arms again.

That’s because Indiana doesn’t have a spiffy little advertisement aimed at tourists. 😉

This is from a couple of weeks ago from this guy who absolutely nails Jindal on just about everything.

This is the most frivolous of frivolous of trademark cases. I guess Bobby J. wanted to reward some law firm with a tidy little contract. The trademark awarded to LA was for the promotion of tourism and as such any use of the mark for “touristy” things would be actionable. If you wanted to be technical here, LA doesn’t even own a trademark, it has been awarded a service mark, since this is a service as opposed to a product. Hard to see anything Moveon.org is saying could be confusing to the marketplace — they don’t seem to be promoting getting on a plane or in a car or in a tuk-tuk to come to LA. Honestly, how thin-skinned could anyone be and still hope to be taken halfway seriously?

MB, a great example of the rampant hypocrisy of our ever “red” fiends — oops, I left out the “r”.

Prolix: You are, of course, so right in the fact that La and the lt. guv can’t do anything about this. Probably lil booby and jay Dardenne will get Jimmy Faircloth to handle the the legal stuff. You can probably google Faircloths’ name and see that booby has gifted him with a million or more in legal fees to handle appeals where the state lost in lower courts and then Jimmy lost the cases on appeal. But the check had already cleared by then so he didn’t care. 😉

@8: DYB, we live in Indiana. I’m not sure it’s actually part of the world. We seem to be drifting in outer space. Gov. Mike Pence thinks it makes perfect sense to deny Medicaid to a paralyzed woman. Be glad you don’t live here.

But what do they think is going to happen? It’s not like she’s suddenly going to find some cash lying around and pay for everything. They WILL have to assist her sooner or later. Why make it so hard for everyone? It’s unconscionable.

@Beata and DYB: I don’t understand either. Normally, these are the types of folks that *are* eligible for medicaid: people who have to go into the hospital, in an emergency situation and who have no assets or insurance. Generally, they will have a social worker at the hospital work with the patient to help them in applying.

DYB, well said, the repubs way end up costing more becuz they have to do everything in such a roundabout way.
