Activist/Feminist Wednesday: Victory is Ours! (And Hillary’s)

Hello y’all, from the Lone Star State! It’s hot and steamy here in Houston. Sometimes the sky just explodes into rain, unable to contain that 99.9% humidity count for one second longer.

I definitely should have planned this week’s post a little better, but with the start of a new project which has about 17,000 moving parts, I must admit I was a bit overwhelmed. My plan was to re-post an old play about FISA, but then I saw this headline:

US Ends morning-after pill fight, will allow girls of any age to buy

And I thought, wow! That is some good news for the Widdershins to wake up to tomorrow morning.

Basically, the deal is this: Morning-after pill was legalized for over-the counter sale to women 17 and over. (Hillary Clinton, in her former job as junior Senator from New York, was one of the key movers and shakers who got this done.)  The age limit was actually instituted, against the findings of her department’s scientists, by HHS Secretary Kathleen Sibelius. After this, women’s rights advocates took the position that if a female is old enough to get pregnant, she should be old enough to terminate that pregnancy if she wants. The ensuing case made its way up to the US District Court, where a lovely judge (Judge Edward Korman) determined that the Obama Administration was full of De Crapola to forbid the drug from being sold to without restriction. This led to Korman’s April 5th ruling that the morning-after pill should be sold to anyone who wanted it. Here’s what happened next: The DOJ appealed. Way to go, most radical pro-choice President evah!

The government had appealed the judge’s underlying April 5 ruling, which ordered emergency contraceptives based on the hormone levonorgestrel be made available without a prescription, over the counter and without point-of-sale or age restrictions.

It asked the judge to suspend the effect of that ruling until the appeals court could decide the case. But the judge declined, saying the government’s decision to restrict sales of the morning-after pill was “politically motivated, scientifically unjustified and contrary to agency precedent.” He also said there was no basis to deny the request to make the drugs widely available.

I believe that was legalese for, “You, sir, are a f*cking idiot. Stand down and stop embarrassing yourself.”

Thankfully, that is what the DOJ did.

The federal government on Monday told a judge it will reverse course and take steps to comply with his order to allow girls of any age to buy emergency contraception without prescriptions.

The Department of Justice, in the latest development in a complex back-and-forth over access to the morning-after pill, notified U.S. District Judge Edward Korman it will submit a plan for compliance. If he approves it, the department will drop its appeal of his April ruling.

“Once the court confirms that the government’s understanding is correct, the government intends to file with the Circuit Court notice that it is voluntarily withdrawing its appeal in this matter,” the department said in a letter to the judge.

Oh snap.

Listen, people. We may think our petitions and emails and calls and marches don’t do anything. But they do!  (Eventually! sigh) When women and men join forces to stand up for women’s rights, EVERYONE wins. And I am so proud of those who have been fighting this particular fight for so many years (including Our Girl!).

So well-done, Judge Korman. I’m glad there are still a few clear-headed judges out there, despite the best efforts of our last two Presnits. And congratulations to women of all ages, who will soon have an alternative to abortions. Good thing too, since clinics are few and far between these days.

“the DOJ appealed it.” Ok, it’s still to early to wrap my head around that. Way to got Mr. “this is what a feminist looks like Prez”. And Ms. magazine should be crawling under the covers in shame.

Actually, MB, I’ve been in Appeals Court (more than once) when a Justice has told a lawyer “sit down”. Yes, it does mean, “You, sir, are making an idiotic argument so stop embarrassing yourself and wasting the court’s time.”

Good to know that the courts do not always get reproductive rights wrong.

This is Great News Madamab, and with all the work Hillary will have to accomplish to correct 8 years of criminal activity and 8 years of indifference having this off her table will be helpful (SHOULD SHE CHOOSE TO RUN) Looks like your amazing Senator is really letting the old grey haired men wearing Stars at the Pentagon have it….I love Gilly I wish we had her. as our senator.

Now The Wonderful Elizabeth Warren is socking it to the banks and Wall Street Interests and making women senators look good. I don’t see how the Democrats cannot run more women in 2014 and 2016 because we now know Women Win.

Looks like we get two more good guys in the Senate too with Markey in Mass sure to win John Kerry’s Seat and Cory Booker in New Jersey….The Democratic Party is looking less old white men that is a good thing. Will we ever get to 302 Women Senators and 150 women in the House we hopefully will achieve the 30% solution in 2014 and 2016!
